The conference attracted significant attention and participation from numerous organizations, agencies, and real estate businesses.
In response to Directive No. 79/CD-TTg dated August 13, 2024, from the Prime Minister regarding the effective implementation of the Land Law, Housing Law, and Real Estate Business Law, and following directives from relevant ministry leaders, as well as based on practical surveys of activities and the needs of the real estate business community, the Vietnam Real Estate Association planned a communication project: Dissemination, Popularization, and Effective Implementation of Legal Policies on Land, Housing, and Real Estate Business.
This project includes a series of activities organized by the Vietnam Real Estate Association in coordination with the Ministry of Natural Resources and Environment and the Ministry of Construction, under the direction of Deputy Prime Minister Tran Hong Ha, as per Document No. 7058/VPCP-NN.
The first event in this series was the Dialogue Conference between law-drafting agencies, experts, businesses, and the press to discuss the understanding and application of the Land Law 2024, Housing Law 2023, Real Estate Business Law 2023, and their implementation guidelines in the practical operations of real estate enterprises.
The objective of the communication project, including the Dialogue Conference, is to disseminate and popularize new points and important issues that citizens and businesses need to be aware of in the three new laws and their implementation guidelines, aiming for accurate understanding and effective, synchronized application. Additionally, the conference provided a platform to listen to the contributions and recommendations of businesses, addressing concerns and obstacles encountered in the practical application of the new legal framework on land, housing, and real estate business. It also clarified the impacts of the new laws on the operations and investment environment of real estate businesses, including opportunities and risks, thereby offering appropriate recommendations for enterprises. Finally, the conference proposed suggestions and solutions to further improve legal policies on land, housing, and real estate business, aiming to create a favorable business environment for enterprises.
Participants invited to the conference included: the Ministry of Natural Resources and Environment, the Ministry of Construction; the Government Office; the State Bank of Vietnam; the Ministry of Planning and Investment; the Ministry of Finance; the Ministry of Culture, Sports and Tourism; the Vietnam General Confederation of Labor; the Economic Committee of the National Assembly; the Law Committee of the National Assembly; and National Assembly deputies. Additionally, the conference was expected to have the participation of local leaders, leading economic and legal experts, representatives of the real estate business community, and numerous journalists from 70 press agencies.
The conference was divided into two sessions. The morning session focused on: Effective application of the Land Law 2024 and its implementation guidelines in the practical operations of real estate businesses. The conference heard presentations from representatives of the Ministry of Natural Resources and Environment, the Economic Committee of the National Assembly, and experts on: Notable new points and considerations in the process of guiding, applying, and implementing the Land Law 2024 by localities and real estate businesses, especially regarding issues with varying interpretations. Furthermore, the conference clarified pressing issues related to: Land use planning, projects; auctioning and bidding for projects; land valuation methods, land price lists; determining specific land prices for cases where land has been allocated or leased before the Land Law 2024; transitional provisions; impacts on real estate businesses and real estate prices when applying new land valuation methods; and other issues that need to be further specified accurately and comprehensively in detailed regulations and implementation guidelines.
The afternoon session focused on: Implementing the Housing Law 2023 and Real Estate Business Law 2023: Opportunities, challenges, and considerations for localities and real estate businesses. Here, the conference heard presentations from representatives of the Ministry of Construction on: New points impacting real estate businesses in the Real Estate Business Law, Housing Law 2023, and detailed regulations; and from experts on: Considerations in the process of guiding, applying, and implementing the Housing Law and Real Estate Business Law by localities and real estate businesses.
Additionally, during the discussion session, representatives of the law-drafting agencies and experts focused on exchanging, clarifying, and addressing concerns of businesses related to: Capital mobilization from housing business, construction works formed in the future; transfer of real estate business contracts; financial obligation guarantees of investors in real estate business formed in the future when buyers do not require guarantees; legal basis for investing and doing business in products like condotels, officetels; social housing, renovation of old apartments, housing standards and regulations; and other prominent issues that need to be further specified accurately and comprehensively in detailed regulations and implementation guidelines to enhance the effectiveness of implementation in practice and facilitate investment and business activities of enterprises.
